1.Acceptance of Terms

Welcome and thank you for your interest in www.skylimit.no (hereinafter referred to as the “Website”). The Website is owned and operated by Skylimit (“Skylimit,” “Company,” “We,” “Us” or “Our”) in accordance with the Norwegian law.

Please carefully read these Terms and Conditions as well as our Privacy Policy (collectively referred to as the “Agreement” or “Terms”). These Terms constitute a legally binding contract between you (“You,” “Your,” “User” or “Consumer”) and the Company regarding your use of the Website and Services offered by the Company.

IF YOU DO NOT AGREE WITH THESE TERMS, PLEASE DO NOT USE THE WEBSITE AND SERVICES OFFERED BY THE COMPANY.

2.Eligibility

You must be at least 18 years of age to use the Services offered by the Company. Where you enter into this Agreement on behalf of another individual, group or entity, you represent and warrant to the Company that you have the authority to act on behalf of that individual, group or entity and to bind the former to this Agreement.

You understand that you will be solely responsible for any bookings made through your account, including but not limited to any payments for such bookings whether made for yourself or another person/entity.

The Website is only available to Consumers who are currently residing in the geographical locations specified on our Website.

3.Account Registration and Security

Although you do not need to create an account to browse through the Website, you do need to sign-up if you wish to make bookings through the Website.

When you register a User Account on the website, you agree that you will only provide accurate, current and complete information when requested. It is solely your responsibility to keep this information up to date. All personal information is collected and processed by the Company in accordance with our Privacy Policy. Please carefully read our Privacy Policy before signing up for an Account.

We reserve the right to terminate your Account if we have any reason to believe that you provided us with false or fraudulent information or in the event of any breach of this Agreement by you. Please note, all Accounts are offered at our sole discretion.

You are solely responsible for protecting your username and password to prevent any unauthorised access to your account.

PLEASE NOTE THAT BY CREATING AN ACCOUNT, YOU UNDERSTAND AND AGREE THAT YOU MAY BECOME LIABLE TO THE COMPANY, OUR SUPPLIERS, AND OTHER THIRD PARTIES FOR ANY UNAUTHORISED TRANSACTION UNDER YOUR ACCOUNT INCLUDING BUT NOT LIMITED TO BOOKINGS OR CANCELLATIONS MADE USING YOUR ACCOUNT.

You hereby release the Company from any claim, loss or damage suffered by you as a result of any unauthorised access to your account and you assume full responsibility for all activity under your account.

The Company reserves the right to restrict access to any User account if we suspect any fraudulent or illegal activity without incurring any liability to you.

4.Skylimit Service

Skylimit is an online travel agency that offers Consumers a convenient way to purchase travel services from third party service providers including airlines, hotels and airport transfer companies (hereinafter collectively referred to as “Supplier”). The Website enables you to easily book flights, hotel accommodation and airport transfer from anywhere and at any time. Unless expressly specified otherwise, when you make a booking through the website and pay for your selected travel service through our secure online payment processor, you are entering into a sale and purchase agreement (“Sale Agreement”) with the Supplier.

Additional Terms

You understand that when you book any travel services through our Website, in addition to these Terms, you will also be bound by Supplier’s terms and conditions related to your booking. You should always read the Supplier terms and conditions prior to booking any flights, hotel accommodation or airport transfer.

Your Bookings

?Booking Flights

When you book a flight through our website, you may choose between a budget airline and full-service airline. Please note that budget airlines have more service limitations than full-service airline and you are hereby advised to carefully read all relevant Airlines terms and conditions prior to booking your flight.

When you choose to book two one-way tickets, each ticket will be governed by its own terms and conditions, and it is solely your responsibility to familiarise yourself of these terms and conditions prior to booking the flight.

Once you confirm your flight booking by making full payment, you will receive the electronic ticket at the email address provided by you in your booking information. Your electronic ticket will carry a unique reference number that you will be required to present on the check-in counter at the airport. You understand and accept that Airlines have the right to change your booking within the first 24 hours from the time of your booking confirmation. In the event of any such change in your booking by the airline, you will be notified at the email address provided by you during your booking.

Please note that all airfares visible on our Website are subject to change at any time without any prior notice to you. We do not offer any guarantees for any airfares until you have purchased your air ticket by making full payment and you have received your ticket. Any subsequent change in airfares after you receive your e-ticket will not have any impact on you.

Travel and Transit times

All flight times you see on our Website show the local time for the relevant airport which may be different from the time at your current geographic location. Please note that all stopover times are provided by the airline and the airport and not controlled by the Company. If you are travelling with multiple airlines on separate tickets, the airline will not be responsible if you miss your connecting flight and therefore it is solely your responsibility to ensure that you will have sufficient time to disembark and board on to your next flight. 

Changes to Flights

Please note that Airlines have the right to change a flight time or cancel a flight at short notice. Any such changes in flight schedules are beyond Skylimit’s control. We will make our best effort to notify you of any such changes via email provided by you during your booking. If you do not accept any such change, you will be bound by the Airline’s cancellation and refund policy which also governs the refund processing time.

You understand and accept that the Company is not responsible for any flight delays, cancellations and other similar service issues that you may encounter while traveling.

Errors and Omissions

Please note that we make use of third-party software on our Website and technical errors may lead to errors in flight pricing, location information and other similar relevant data. We will make our best effort to rectify any such errors and omissions immediately upon becoming aware of it. In the event you make a booking with the incorrect price, we reserve the right to cancel such booking without incurring any liability to you. In the event of such cancellations, whenever possible we will offer you another opportunity to book the flight at the correct price.

?Accommodation

When you make any hotel reservations through our website, you understand that you are entering into a legally binding agreement with that hotel. Please take the time to review the hotel terms and conditions and make sure that it offers the amenities to suit your unique needs.

Hotels can change their pricing at any time without giving any prior notice to you. We only display hotel information that is provided to us. We do not receive any notices from hotels regarding renovations/onsite work that may interfere with your experience. You should always notify the hotel of any special needs that you may have prior to your booking to ensure that the hotel is able to accommodate you.

The Company will not be a party to any disputes between you and the hotel arising out of or associated with any inconvenience or dissatisfaction with the hotel accommodation and amenities. Please note that some hotels may offer gratuities for larger groups which may not be available to smaller groups. These gratuities are offered solely at the hotel’s discretion.

Hotels may require you to pay a deposit amount to confirm your booking. Once you confirm your booking, you will receive a confirmation message at the email address provided by you during your booking. You will receive the full booking information including the Hotel address, contact number as well as the booking reference number that should be presented at the Hotel at the time you check-in.

Assumption of risk

You understand and accept that when you make any Bookings that include activities offered by the hotel, your decision to participate in activities is entirely at your own risk. You acknowledge that most activities may involve some risks, personal property damage or other personal losses. You acknowledge that any such activities offered by the Supplier is voluntary and not induced by the Company.

?Transfers

When you book transfers through our website, you are entering into a legally binding agreement with the Supplier of the requested service, and you will be bound by such Supplier’s terms and conditions. Please review the Supplier’s terms and conditions prior to making any bookings. Your booking will be deemed confirmed upon receipt of confirmation email from the Supplier. You will receive a transfer voucher upon confirmation, and you may be required to present this voucher at the time of your pick-up.

Transport Service providers are free to change their prices at any time without giving any prior notice to you. Any change in pricing after your booking is confirmed will not impact you.

Changes to your bookings

You understand and accept that your transfer booking will include the pickup and dropoff address as specified by you. If there is any change in this information, you are required to notify the Supplier immediately. We are unable to offer you any assurances that the Supplier will accept any changes in your booking or that you will not incur any additional costs for change in your bookings.

Special Requests

You are generally given a choice to book a child or baby seat at the time of your booking. If you were not given the opportunity to book a child or baby seat, you should notify the Supplier of your needs and confirm the availability of suitable child restraint during transfer. It is solely the responsibility of the parent/legal guardian who is accompanying the minor or who makes the booking to ensure that the child restraint device is suitable. The Company assumes no liability resulting from your failure to do so.

Please note that some Suppliers may not allow minors to travel unaccompanied and you should always confirm such special circumstances with the Supplier prior to making any bookings.

YOUR PRIVACY WHEN MAKING BOOKINGS

Please note that when you make any Bookings through our Website, your personal information will be passed on to the relevant Supplier. All personal information passed on to the Supplier during your booking will be governed by that Supplier’s Privacy Policy. Please take the time to review the Supplier Privacy Policy before providing any personal information and only submit your personal information if you agree with the Supplier’s Privacy Practices.

5.Skylimit Prices and Payments Policy

All prices visible on our website are subject to change without any prior notice to you. Suppliers are in full control of their pricing, and the Company is unable to offer any guarantees as to pricing until your booking is finalised. Please note that prices, as displayed on our website, is inclusive of all applicable airport taxes and charges but exclude environmental levies/tourist taxes that are only payable when you arrive at your destination.

Although we take all reasonable care to ensure all prices as listed on our website are correct, we cannot offer any guarantees. In case of errors in pricing, we may rectify the prices on our Website without incurring any liability to you including cancelling any bookings made at incorrect prices.

We currently use a secure payment processor to process all payments on our Website. By making a payment through our selected payment processor, you further agree to abide by our selected payment processor’s terms and policies. You are required to authorise the full payment when you make the booking.

In the event of any suspicion of fraud or unauthorised activity, our payment processor may decline to process such payment and put funds on hold for further investigation. In such cases, we will request you to provide additional supporting information. Your failure to present such requested information may lead to cancellation of your booking request, and you may become liable for the payment of any transaction charges incurred by us. 

Payment method: We offer payment with Visa and MasterCard.

6.Cancellation and Refunds

Each service booked through the website is governed by its own cancellations and refunds policy which is included in the Supplier terms and conditions. You are advised to review these Supplier terms and conditions carefully prior to making your bookings. Where Supplier terms and conditions allow cancellations, you may do so through our website at www.skylimit.no or by sending us an email at [kundeservice@skylimit.no] with your booking details. We will pass your cancellation request to the Supplier who will process your request according to their terms. Where you qualify for a full or partial refund, the refund will be processed within the estimated timeframe specified by the Supplier. All refunds are processed using the same payment method that you used to make your booking and made to the person who made the original payment.

Where applicable, you may become liable for the payment of cancellation fees as specified on the Supplier cancellation policy.

The Company also reserves the right to impose cancellation fees in addition to Supplier cancellation charges in its sole discretion.

When changing for example changed departure date, changed destination, change of departure, changed hotel and changed travel length there will be fee charge of 599kr

FLIGHT DELAY, CANCELLATION AND INVOLUNTARILY DENIED BOARDING

Under EU Regulation 261/2004, passengers in certain circumstances may be eligible for airline compensation. These circumstances include flight delays, cancellations and instances where passengers are involuntarily denied boarding on an overbooked flight departing from an EU airport. Please note that such compensation is the responsibility of the airline and not the Company. You are advised to obtain proof of the incident from the airline to enable you to claim appropriate compensation.  

7.Travel Insurance

We encourage you to take out travel insurance before your trip. Travel insurance can include cancellation cover as well as financial assistance in certain circumstances. It is solely your responsibility to take out suitable travel insurance from a provider of your choice. The Company will not be held liable for any loss, damage, claim or inconvenience suffered by you or any other party as a result of your failure to take out suitable travel insurance.

8.Your Responsibility

You understand and accept full responsibility for:

?International Travel Documents

When you travel internationally, you have to fulfil certain foreign entry requirements such as a valid passport, suitable visa as well as any other entry requirements.  Please note that the names of all passengers must match the name on the passport and this includes infants travelling with their parent/legal guardian. You understand that you will be denied boarding if you fail to present relevant travel documentation when requested. Some destinations also require you to take inoculation and medication prior to your trip. You are hereby advised to consult with your doctor and fulfil all such health requirements. 

It is solely your responsibility to investigate all the relevant foreign entry documents that you require and to obtain them in time before departure. We do not represent to possess any special knowledge of any foreign entry requirements, and we will not be held liable for your failure to obtain all such required travel documents.

ANY HOTELS, FLIGHTS AND TRANSFERS TO A PARTICULAR DESTINATIONS SHOULD NOT BE DEEMED AS  AN ENDORSEMENT OR RECOMMENDATION BY THE COMPANY. YOUR DECISION TO TRAVEL TO ANY DESTINATION IS SOLELY AT YOUR OWN RISK.

?Your Luggage

It is solely your responsibility to review the hand luggage and check-in luggage rules prior to your booking. If you wish to carry extra luggage or if you will be travelling with special baggage, you should send your enquiries directly to the relevant airline or send an email to [kundeservice@skylimit.no], and we will pass on your request to the relevant airline. You understand that you may be required to pay a luggage fee to the airline. Where applicable, such luggage fees are payable directly to the airline.

We do not assume any responsibility for your lost or damaged luggage, and your sole remedy in such cases is to raise a dispute with the airline in accordance with the airline’s complaints procedure.

?Infants and Minors

It is solely your responsibility to provide the correct age of infants and minors travelling with you. Please note that the age of the Child on the date of return is viewed as the correct age for all travel purposes. If the child is travelling unaccompanied, please send us an email prior to making any payments for your bookings.

9.Reviews, Comments and other User Content

The Company does not offer any warranties as to the authenticity, accuracy or legality of any content or information posted, uploaded or shared by Consumers on the Website. You hereby accept that your use of the Website and access of all User content provided therein is at your sole risk, and you will be solely responsible and liable for any loss or damage that may arise as a result therefrom.

For purposes of these Terms, any reference to the word "Content" includes, without limitation, any User comments, ratings, reviews, recommendations, photographs, videos uploaded/posted our Users.

We may use User Content in a number of different ways including but not limited to, publicly displaying it, incorporating it into marketing materials, advertisements and other works to promote our Website. By posting any User Content on the Website, you hereby do and shall grant the Company a worldwide, non-exclusive, royalty-free, fully sublicensable and transferable license to use, reproduce, display, publish or otherwise fully exploit your User Content. You further represent and warrant that you have all the rights in your User Content to grant such license to the Company and that your submission of your User Content does not violate any third-party’s intellectual property rights. You acknowledge and agree that any content you upload or post on the website is non-confidential and non-proprietary. You expressly waive any moral rights that you have in your User Content and agree that you will not object to the publication, use, modification, deletion or exploitation of your User Content by the Company.

You understand that all information publicly posted or privately transmitted through the Website is the sole responsibility of the User from whom such Content originated.

The Company will not be liable for any errors or omissions in any Content. You hereby expressly release the Company from any liability arising out of or associated with your use of any Content available on the Website.

10.Our Intellectual Property

All content available on the Website including without limitation, the text, graphics, logos, trademarks, audio, video, interactive features, software and the like (“Company Content”) are either owned by or licensed to the Company or by its Users and other third-party licensors. All Company Content is subject to trademark, copyright and other intellectual property laws and international conventions. You understand that the Company Content is provided to you for your personal and non-commercial use only. Any act of copying, selling, reproducing, republishing, modifying, distributing and creating derivative work of any Company Content without our express written consent will amount to a violation of intellectual property laws.

You agree that you will not remove any copyright, trademark and other proprietary notices from any Company Content that you do not have rights to use. You are expressly forbidden from using the Company content on any other website, system or application for any purposes other than those expressly outlined herein.

The Company grants you a revocable, non-exclusive, non-transferable license to use the Website for your personal use only, in accordance with this Agreement. Any rights not expressly granted in this provision are reserved.

11.User Conduct

By using the website and services offered by the Company, you expressly agree that:

  • You will abide by all the provisions of this Agreement;
  • You will not misrepresent any information that you provide through the Website to the Company or the Suppliers during any Bookings;
  • You will take full responsibility for the accuracy and legality of all your Content;
  • You agree to cooperate in the amicable resolution of any disputes with Suppliers or the Company;
  • You will ensure that you are aware of any applicable laws and regulations governing you;
  • You will not use the website for any illegal activity;   
  • You will not use any Content available on the website, whether provided by the Company, its Suppliers or another User, either online or offline, for any commercial use without obtaining appropriate licenses and authorisation from the Copyright Owner;
  • You will not post any offensive, obscene, degrading, misleading or harmful text, video or images on the website;
  • You will not post, upload or in any other way distribute any content that may be harmful to the Company, any User or a third party;
  • You will not post, upload or in any other way distribute any content or information that is false, inaccurate, misleading, fraudulent or deceptive in nature;
  • You will not infringe any User or third party’s copyright, patent, trademark, trade secret or other proprietary rights or intellectual property rights including but not limited to rights of publicity, confidentiality or privacy;
  • You will not act in any manner that may lead to a violation of any applicable laws or regulation, including but not limited to those governing export and import control and trade practices;
  • You will not post, upload or share any content that may be deemed defamatory, libellous, or threatening;
  • You will not, intentionally or unintentionally cause harm or subvert the function of the Website by introducing any viruses, trojan horses, time bombs, cancelbots or other computer programming routines that may damage, modify, delete or interfere with any system, data or personal information stored on the website;
  • You will not impersonate another User;

If we discover that you have violated any of the aforementioned terms, we reserve the right to block your account and take any appropriate legal action to ensure the safety of our Users.

12.Disclaimer and Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW THE COMPANY DISCLAIMS ALL LIABILITY FOR ANY ERRORS OR INACCURACIES IN  INFORMATION OR DESCRIPTION OF ANY AVAILABLE FLIGHTS, TRANSFERS AND HOTELS ON THE WEBSITE, INCLUDING BUT NOT LIMITED TO PRICING, PHOTOGRAPHS AND SERVICE DESCRIPTION. THE COMPANY ALSO RESERVES THE RIGHT TO RECTIFY ANY SUCH ERRORS IN INFORMATION AND IN BOOKINGS BY CANCELLING THE BOOKING WHICH WAS MADE UNDER  INCORRECT PRICE AND OFFERING THE CONSUMER AN OPPORTUNITY TO MAKE THE BOOKING AT THE RIGHT PRICE, WHENEVER POSSIBLE.

ALL SERVICES LISTED ON THE WEBSITE ARE SUBJECT TO AVAILABILITY AND COMPANY IS UNABLE TO OFFER CONSUMERS ANY GUARANTEES OF ANY NATURE REGARDING SUCH AVAILABILITY.

IN NO EVENT SHALL THE COMPANY, ITS DIRECTORS, EMPLOYEES, SUB-CONTRACTORS, AGENTS OR AFFILIATES BE LIABLE FOR ANY INCORRECT OR INACCURATE INFORMATION PROVIDED BY ANY USER OR SUPPLIER ON THE WEBSITE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY DISCLAIMS ALL LIABILITY FOR ANY LOSS OR DAMAGE, INCLUDING LOSS OF INFORMATION, PERSONAL INJURY OR DEATH.

THE COMPANY NEITHER REPRESENTS NOR WARRANTS THAT THE USE OF THE WEBSITE WILL MEET YOUR EXPECTATIONS OR YOU WOULD ACHIEVE ANY SPECIFIC RESULTS. 

IN NO EVENT SHALL THE COMPANY BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL AND CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES OF ANY KIND BASED IN BREACH OF CONTRACT, NEGLIGENCE, TORT OR OTHER LEGAL THEORY ARISING OUT OF OR ASSOCIATED WITH:

  1. ERRORS, OMISSIONS OR INACCURACIES IN ANY CONTENT WHETHER POSTED BY A USER OR OBTAINED BY THE COMPANY FROM A SUPPLIER;
  2. ACCESS TO OR USE OF THE OF THE WEBSITE, OR INABILITY TO USE THE WEBSITE;
  3. ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICE;
  4. ANY BUGS, VIRUSES, TROJAN HORSES OR THE LIKE WHICH MAY BE TRANSMITTED TO OR THROUGH THE SERVICE;

NOTWITHSTANDING THE FOREGOING, NOTHING IN THIS LIMITATION OF LIABILITY SHALL EXCLUDE THE LIABILITIES THAT CANNOT BE EXCLUDED BY APPLICABLE LAW. UNDER NO CIRCUMSTANCES SHALL THE COMPANY’S LIABILITY TO YOU EXCEED NOK 100.

13.Governing Law and Jurisdiction

This agreement between the Consumer and the Company and all disputes arising hereunder concerning these Terms shall be governed by Norwegian Law. Both parties submit to the exclusive jurisdiction of Oslo District Court, Norway for resolution of any disputes arising out of or concerning this Agreement.

15.Force Majeure

Neither the Company nor the User will be held liable for failure to perform any of their obligations towards the other if such failure is as a result of a force majeure event or acts of God (including fire, flood, earthquake, storm, hurricane or other natural disasters), war, invasion, act of foreign enemies, hostilities (regardless of whether war is declared), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalisation, government sanction, blockage, embargo, labor dispute, strike, lockout or any interruption or any failure of electricity or server, system or telephone service.
